On 06/15/2019 at approximately 2134 hours, an Officer from the West Manchester Township Police Department was traveling westbound on West College Avenue approaching Woodberry Road.
While travelling westbound on West College Avenue, the Officer witnessed a black sedan turn left from Woodberry Road to travel eastbound on West College Avenue. The black sedan completed the turn on an angle which caused the suspect vehicle to cross the double yellow center lines. As the suspect vehicle passed the patrol vehicle, the Officer could hear the vehicle's engine rapidly accelerating. In the driver's side view mirror, the Officer witnessed the suspect vehicle begin to lose control and slightly "fish tail." The Officer turned the patrol vehicle around to conduct a traffic stop and witnessed the suspect vehicle quickly creating distance from the Officer. The suspect vehicle appeared to be travelling in excess of 100 mph in a posted 55 mph zone. As the suspect vehicle entered the 35 mph zone it quickly slowed but appeared to be still travelling in excess of 50 mph. The Officer conducted a traffic stop by activating the emergency lighting. The suspect vehicle's right turning signal was activated and the driver stopped the vehicle on the right shoulder in the area of South Adams Street.
The Officer approached the open driver's side window and made contact with the driver identified as Thomas Steiner. Immediately, the Officer detected a moderate to strong odor of alcohol coming from within the vehicle. The Officer requested the reasoning of Steiner traveling at a high rate of speed and Steiner was silent. Steiner produced a blank stare with his eyes producing a glass appearance. Steiner attempted to speak but mumbled his words and could complete sentence. When Steiner attempted to speak his breath produced a strong odor of alcoholic beverages. Due to the clues presented, the Officer requested Steiner exit the vehicle to perform field sobriety testing.
The SFST’s were performed and Steiner showed signs of impairment.
The Officer approached Steiner with the portable breath tester and explained the process. Steiner refused to attempt to produce a breath.
Steiner was taken into custody for suspicion of driving under the influence of alcohol and advised of his Miranda warnings verbally. Steiner waived his rights and spoke with the Officer.
Steiner admitted to consuming two Four Loko alcoholic beverages approximately two hours prior to police contact. Steiner denied using marijuana or being prescribed any medications for his herniated disks.
Steiner admitted that he was travelling at approximately 140 mph just prior to police contact. Steiner chuckled and stated, "I wanted to see how fast it would go!"
On 06/15/2019, at approximately 22:10 hours, the Officer transported Steiner to the York County Central Booking Center for blood alcohol content exam. The Chemical Testing Warnings (DL-26B) form was read to Steiner while being recorded. Steiner refused the exam and signed the form indicating that he was advised of the warnings.
Based on the above information, Thomas Eugene Steiner was charged with 1 count of DUI- Refusal, Misdemeanor and 1 Traffic Violation.
