On 6-9-2019 at approximately 1137 hours an Officer from the West Manchester Township Police Department received a call in regards to an erratic driver. The vehicle was described as a black BMW with PA registration. The caller who was following the vehicle, reported to YCC that the vehicle was traveling northbound on Carlisle Road and was to be swerving and almost hit several parked cars on the roadway. A few minutes later, a second caller reported that the same vehicle was driving in two lanes on Carlisle Road and that the vehicle almost caused several accidents. The caller reported that the vehicle was to be parked in front of the Wine and Spirits store in the West Manchester Town Center.
The Officer responded to the location and observed the vehicle at a distance. As the Officer was approaching the vehicle he observed a female, who was later identified as the Defendant Kandi Saikia, exiting the Wine and Spirits store. She was stumbling as she walked and was carrying a bag with her. The Defendant got into the BMW and began to back out of the parking space. Based on the reports as well as the Officer’s observations, a traffic stop was conducted.
The Officer approached the vehicle and made contact with the Defendant. The Officer explained to the Defendant that we had received complaints about her driving. As the Officer was speaking to the Defendant, he observed that her eyes were glassy and that her speech was slurred. He also observed 2 empty bottles and 2 full bottles of Smirnoff vodka in her open purse on the passenger seat. The Officer asked the Defendant if she had consumed any alcohol prior to driving and she stated that she was drinking vodka in the morning. The Officer attempted to have the Defendant blow into a PBT, however she was unable to do so to register a reading.
The Officer had the Defendant exit her vehicle and explained to her that he was going to conduct field sobriety testing to determine if she was capable of safe driving. The SFST’s were conducted and the Defendant showed signs of impairment.
The Officer advised the Defendant that she was under arrest for DUI and mirandized her. He took the Defendant to the York Hospital for a blood draw. The Defendant's blood was drawn.
The Defendant's toxicology report was completed by NMS Labs on 6-18-2019. The report concluded that the Defendant's BAC was .316%.
Based on the above information, Kandi Sue Saikia was charged with 2 counts of DUI, Misdemeanor.
