On 06/16/2019, at approximately 2004 hours, an Officer from the West Manchester Township Police Department was on duty in a marked patrol vehicle exiting the Kinsley Quarry on the west side of Hokes Mill Road in the area of the West College Avenue overpass.
While stopped at this location, the Officer witnessed a Hyundai Sonata approaching while travelling s/b on Hokes Mill Road. The suspect vehicle appeared to be travelling at a speed greater than the posted 25 mph speed limit. The operator, later identified as Amanda Eckard immediately braked the vehicle. The occupants appeared to have a surprised look and immediately made quick movements. The movements appeared to be related to securing their restraint systems. The Officer followed the suspect vehicle while it was travelling at approximately 42 mph in a posted 35 mph speed limit zone. As the suspect vehicle negotiated a right and left curve on Hokes Mill Road, the Officer witnessed the suspect vehicle being operated on the fog line for approximately 50'. A traffic stop was initiated at Hokes Mill Road and Indian Rock Dam Road. The vehicle stopped on a left curve and failed to use available space to keep the vehicle from blocking the s/b lane of Hokes Mill Rd.
The Officer approached Eckard and made contact through an open driver's side window. Immediately, he detected a faint to strong odor of fresh marijuana coming from within the vehicle. As Eckard looked at the Officer’s direction, he noticed her eyes appeared to be faintly bloodshot and had a glassy appearance. .
A Sergeant reported that he asked the occupants if they had anything illegal in the vehicle. Eckard reportedly stated, that she did not have any marijuana, she was just smoking it. Eckard reportedly stated, "two hours" when asked the last time that she smoked marijuana.
A Sergeant conducted field sobriety tests on Eckard and subsequently placed her under arrest for suspicion of driving under the influence of controlled substances. Eckard showed signs of impairment during standardized field sobriety testing.
Eckard was transported to York Hospital where she was read the DL-26B form verbatim. Eckard consented to the blood exam.
On 06/26/2019, the Officer received an NMS Labs toxicology report which included the following positive findings:
- 5.3 ng/mL of 11-Hydroxy Delta-9 THC
- 83 ng/mL of Delta-9 Carboxy THC
- 10 ng/mL of Delta-9 THC
Based on the above information, Amanda Lynn Eckard was charged with 1 count of DUI, Misdemeanor.
